Psychological Evaluation For Immigration Proceedings

Immigration laws place the burden of proof on the applicant or beneficiary to show psychological distress. This is often supported by a psychological evaluation and/or expert testimony by a mental health professional. 

Psychological evaluations are helpful and/or required to complete immigration proceedings. Often immigration attorneys encourage their clients to acquire a psychological evaluation.  The purpose of the evaluation is to better understand the psychological impact the immigration process has on the individual.  

These types of reports are specific with respect to the issues that must be addressed, and only trained mental health professionals are able to provide these services. Through my practice I offer psychological evaluations, which can be performed in either English or Spanish for immigration proceedings in:

  • Hardship (Waivers, Provisional Waivers and Cancellation Removal)

  • Violence Against Women Act (VAWA)

  • U Visas

I have three specific goals when conducting an evaluation to make the process as comfortable as possible.    

  1. To work collaboratively with immigration attorneys to best serve their clients’ needs.

  2. Create a safe and comfortable environment for the client.

  3. Accommodate the client’s needs with regards to scheduling the day and time of the evaluation appointment.

What you can to expect:

An evaluation consists of a one-on-one interview which includes completing questionnaires prior to the interview. The interview and questionnaires are then interpreted and scored before being integrated into a single report. That final report is sent confidentially to you or the attorney handling your case. Generally, the report will be submitted to you or your attorney.
